My daughter joined a gym, contract says for one year. Her and her boyfriends' name is on the contract, however the boyfriend did NOT sign the contract. Her signature is the only one on it. They are bank drafting her for two persons, not one. At the time she joined, she had a good paying job and not attending school. Now she has lost that job, working 15hrs a week and I am paying her way to school. She asked for a 90-day hold on the payments, and they have not followed their words. She is continuing to be billed for it. This gym is a Franchise and are not willing to cancel the contract. How can we do this legally without any problems down the line.

Cancel the automatic withdrawals…..She has the sole authority of what goes out and can revoke the authorization at any time. Expect them to come after her by way of a collections agency but they cannot force her to pay either. Unless it is a huge amount they tend to drop it as its not worth continuing. Collection agencies usually demand 40% of what they get off the person. Most gyms are less than 50 bucks a month, it won't be worth it to them. But then again, it just might.
Still cancelling the withdrawls keeps her money in her bank.
